Disclaimer: This agreement is a plain-English summary of the terms posted on our website, and those posted terms are the official version. Questions before you sign? Just ask, and we'll walk you through it.
1. Who this agreement is between
This agreement is between Kind Regards Media (owner: Brett Lowery; email: kindregardsmediaus@gmail.com), called "we" or "us", and the client named in the signature section below, called "you". In the Roseburg area, Tyson Fugate works with local businesses for Kind Regards Media on the same plans, prices, and terms.
2. What we do: the plan you choose
You choose one plan in the signature section. Each plan is billed monthly, in advance.

Reviews Only details
Google reviews only, with no listing care or posts. If you go over 20 reviews two months in a row, you choose: move up to Starter, or pay $3 per extra reply on a separate one-time invoice. Your $99 stays the same.
On Reviews Only, extra replies ($3 each) only come up if you go over 20 Google reviews two months in a row and choose them instead of moving up to Starter. They're billed on a separate one-time invoice, and your $99 a month stays the same.
One-time costs
- Setup, $199 once. For Starter, Growth, and Full Service, billed at signing. We review and clean up your profiles, claim or verify your Google listing, and set up our access. Waived for founding clients. Reviews Only has no setup fee.
- Simple website, $1,200 once. Up to 5 pages (like Home, Services, About, Gallery, and Contact) that look good on phones and computers, on Squarespace or Wix, with a contact form, a map, links to your profiles, and up to two rounds of changes. Billed half at signing and half before the site goes live. $950 if you also choose Full Service. You buy the platform plan, domain, and any paid add-ons in your name and pay for them directly.
Not included in any price
- Costs from other companies. For example, a website platform plan, a domain, stock images, paid ads, or software you ask for. You pay these, and you approve each one first. Website platform plans, domains, and add-ons are bought in your name and paid by you directly.
- Work outside our plans. Paid ad management and ad spend, professional photo or video shoots, online stores, and crisis or PR management.
3. Founding-client offer (if it applies to you)
Founding-client offer: first month free, $199 setup waived. Your plan price starts in month two. Any plan, including Reviews Only. Your plan price is held for 12 months. The setup waiver applies to Starter, Growth, and Full Service, since Reviews Only has no setup fee.
The offer covers your plan's first month and, on Starter, Growth, and Full Service, the setup fee. A website build is billed at its listed price. After the free month, keep going month to month or stop. We only name your business or share your work with your written OK.
4. Paying
- Plans are billed in advance, on the 1st of the month or on your monthly start date.
- Each month, you get an invoice by email through Square. Pay it by card or bank transfer (ACH) within 7 days.
- Or save a card or bank account on file, and each invoice is paid automatically on its due date. You get an emailed receipt each time.
- To stop automatic payments, email us at least 5 business days before the next charge. This doesn't cancel your plan.
- Setup ($199) is billed at signing on Starter, Growth, and Full Service, and waived for founding clients. Reviews Only has no setup fee. A website is billed half at signing and half before it goes live.
- If an invoice is still unpaid 7 days after its due date (14 days after it's sent), a flat $25 late fee is added to it.
- If a payment is more than 15 days late, we may pause work until it's paid.
5. Term, cancelling, and changes
This agreement starts on your start date and runs month to month. There is no minimum term, no early-termination fee, and no renewal date to watch for.
- No contract. Either of us can cancel for any reason with 30 days' notice. Email is fine.
- Service and billing continue through the 30 days. Anything you prepaid past that is refunded.
- Partial months aren't prorated unless we both agree.
- Change plans by email. The change starts with your next billing cycle.
- We give at least 30 days' written notice before any price change.
6. Approvals and what we need from you
We send posts ahead of time. You can approve, edit, or reject each one. If you like, routine posts can go ahead when you haven't replied in two business days. Replies to positive reviews use wording you approve ahead of time. Replies to negative or sensitive reviews never go up without your OK.
You agree to give us manager access to the accounts your plan covers, help with Google's verification steps if they need you, and send us photos or details we ask for. Ask us to change or remove anything, and we'll do it within one business day.
7. Your accounts, access, and content
- Your Google, Facebook, Instagram, website, and domain stay in your name. We use manager access, never owner access. We never ask for your personal passwords.
- You stay the owner and can remove our access at any time.
- If you leave, we stop posting, remove our access, and give you your files.
8. Privacy and confidentiality
We keep your business information private and use it only to do the work in your plan, bill you, and keep you updated. We only name your business or share your work with your written OK. Our privacy policy explains what we collect and how we handle it.
9. No guarantees we can't keep
Rankings, reviews, and sales depend on things no one controls, including Google's and Meta's own systems. We promise the work in your plan, done on schedule, and a clear report each month. We never post fake reviews, buy followers, or reward people for reviews.
10. Limits on responsibility
We only owe you money if a problem was caused entirely by our own mistake and it harmed your business. Not getting the results you hoped for, such as rankings, reviews, leads, followers, or sales, is not a mistake on our part and is never a reason for a payment or refund. Neither of us is responsible for losses caused by things outside our control, such as changes, outages, or decisions by Google, Meta, Square, or other platforms. For any claim connected to this agreement or our services, whether based on the contract, negligence, or anything else, the most we owe in total is what you paid us in the 3 months before the problem started, to the extent the law allows. This limit doesn't reduce any refund another section of this agreement specifically promises, such as prepaid months after you cancel.
11. The fine print, kept short
- Oregon law applies to this agreement.
- The whole agreement. This page and the prices on our website are the whole agreement. Any change has to be agreed by both of us in writing, and email counts.
- Signing electronically. You agree to sign and receive this agreement electronically. You'll need a web browser and email to do that, and you can print or save a PDF copy at any time. If you'd rather have a paper copy, or want to stop doing this electronically, email us and we'll send one at no charge.
- Questions? Email kindregardsmediaus@gmail.com. We reply within one business day.
